Agreement to Terms

By accessing or using LaborVault at laborvault.com, you agree to be bound by these Terms and Conditions. LaborVault is operated by Lisemby Enterprises LLC, a Texas limited liability company. If you do not agree to these terms, do not use our platform.

Description of Service

LaborVault is a construction labor marketplace that connects contractors with skilled workers. We provide a platform for workers to create profiles showcasing their trades, skills, and availability, and for contractors to browse, rate, and hire workers. LaborVault is not an employer, staffing agency, or labor broker. We facilitate connections between independent parties.

Eligibility

You must be at least 18 years old to use LaborVault. By creating an account, you represent that you are at least 18 years of age and that the information you provide is accurate and complete. You are responsible for maintaining the security of your account credentials.

Worker Accounts

Workers who sign up on LaborVault agree to provide accurate information about their trades, skills, and experience. Worker profiles are visible to contractors on the platform. Workers are independent contractors and are not employees of LaborVault or any contractor who hires them through the platform, unless separately agreed upon between the worker and the contractor.

Contractor Accounts

Contractors who use LaborVault agree to provide honest and fair ratings of workers. Contractors are responsible for their own hiring decisions, workplace safety, and compliance with all applicable labor laws. LaborVault does not guarantee the quality, reliability, or legal status of any worker on the platform.

Text Message Program (SMS Communications)

By providing your phone number and creating an account, you consent to receive text messages from LaborVault. These messages include job dispatch alerts, profile update reminders, and account notifications.

Supported carriers include AT&T, T-Mobile, Verizon, and other major US carriers. Carriers are not liable for delayed or undelivered messages.

Ratings and Reviews

LaborVault allows contractors to rate and review workers. All ratings must be honest and based on actual work experience. We reserve the right to remove ratings that are fraudulent, abusive, or that violate these terms. Workers may not solicit, pay for, or falsify ratings.

Prohibited Conduct

You agree not to use LaborVault for any unlawful purpose, to harass or threaten other users, to submit false or misleading information, to impersonate another person, to attempt to gain unauthorized access to our systems, or to use the platform in any way that could damage or overburden our infrastructure.

Disclaimer of Warranties

LaborVault is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of worker profiles, ratings, or any information provided by users. We are not responsible for the conduct of any user, whether online or offline.

Limitation of Liability

To the fullest extent permitted by Texas law, Lisemby Enterprises LLC and its owners, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of LaborVault, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim related to the platform shall not exceed $100.

Indemnification

You agree to indemnify and hold harmless Lisemby Enterprises LLC, its owners, and affiliates from any claims, damages, or expenses arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.

Termination

We may suspend or terminate your account at any time and for any reason, including violation of these terms. You may deactivate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or your use of LaborVault shall be resolved in the courts of Lubbock County, Texas.

Changes to Terms

We may update these terms from time to time. If we make material changes, we will notify you by text message or by posting a notice on our site. Continued use of LaborVault after changes are posted constitutes acceptance of the updated terms.
